Court cancels 41 shady land deals along Pakistan border

Barmer: A Rajasthan court has cancelled 41 shady land deals along the international border in Barmer and transferred the strategic land to the government control, according to a public prosecutor on Sunday.
The court directed the government to pay back the amount to the buyers, if any of them turns up, with 9% interest. The decision was delivered on Saturday.
The union government had declared the land along the sensitive Pakistan border as notified and restricted all entries without authorised permission. However, thousands of bighas of land was sold to buyers through alleged shady deals in Barmer, Jaisalmer, Jalore, Sri Ganganagar and Bikaner, which share international border with Pakistan.
The issue came to light in 2006. The government objected to the same and the issue went to various courts. About 950 cases were registered. Out of which 300 cases have been decided while remaining are pending at various courts.
On Saturday, Barmer additional district and sessions judge LD Kiradu cancelled the 41 deals, involving 3,000 bighas of land along the international border and ordered it in the government control.
Over the past three months, additional district and sessions court-II has dismissed about 250 dubious such land deals involving 20,000 bighas of land. But, this court had not directed the government to pay the amount to the buyers.
Suresh Modi, additional public prosecutor at additional district and sessions court-2 said that the decision was ex-parte because neither the buyers nor their lawyers had turned up during the trials.
During the argument in the court on Saturday, additional public prosecutor Ganpat Gupta contended before the judge that since the land had been notified by the union government any act done in this area without a proper permission from a competent authority was illegal and in such scenario such deals should be dismissed.
However, buyers’ lawyer Ummed Singh pleaded that there was restriction on the entry of outsiders into the area but not on the purchase of property therein.
He also informed the court that no notice had been received by the buyers in this connection. He appealed to the court that it had not been proved that these deals were dubious and considering such facts such deals should not be dismissed.
